Terms of Service
The short version: FixlyPros connects you with independent service providers at a published, flat price. We take payment at checkout and hold it, you can cancel for a full refund until the job is complete, and the provider — not us — performs the work.
The rest of this page is the detail.
1. This agreement
These terms are an agreement between you and Kemp Tech, LLC, doing business as FixlyPros (“we”, “us”). They apply whenever you use FixlyPros — as a customer, as a service provider, or both.
By creating an account or booking a service you accept these terms. If you do not accept them, do not use FixlyPros.
2. What FixlyPros is
FixlyPros is a marketplace, not a contractor. We connect customers with independent service providers. We do not perform the work ourselves.
Providers on FixlyPros are independent businesses. They are not our employees, agents, or subcontractors. They control how they do their work, what jobs they accept, and when they work. We screen providers before approving them and we set the published price for each service, but the work itself is performed by the provider under a direct arrangement with the customer.
The contract for the work is between the customer and the provider. Our role is to run the platform, publish the prices, take payment, and pay the provider.
3. Your account
- You must be 18 or older and able to enter a contract.
- Give accurate information and keep it current. A wrong service address is the most common cause of a job going wrong.
- You are responsible for what happens under your account. Keep your password to yourself and tell us if you think someone else has access.
- One account per person. Creating a second account to get around a suspension is a breach of these terms.
4. Prices and what they include
Every service is priced by the project, never by the hour. The price for each service is published on its service page, and that is the price you pay for that work. If you book more than one service, the prices add up.
- Each service carries a visit minimum. The minimum differs between services and is shown when you book. If what you have selected comes to less than the minimum for that service, the minimum applies.
- You supply parts and materials unless the service says otherwise. Small hardware and consumables — screws, anchors, wire caps and the like — are included. Larger items such as fixtures, devices, paint, and furniture are not. Your provider can confirm what is needed before the visit.
- Some services are priced in tiers by size or type. The tier you choose determines the price.
- A card surcharge may be added at checkout depending on how you pay. It is shown before you confirm.
If a job turns out to be materially different from what was booked, the provider should raise it with you before continuing rather than doing the work and disputing the price afterwards. Additional work means an additional booking at its published price.
5. Booking and payment
When you submit a service request it becomes visible to approved providers in your area, who may accept it. Submitting a request is not a guarantee that a provider will take it.
Payment is taken when you check out, not after the work is done. Holding payment is what lets a provider accept the job knowing it is funded. Your money is refundable under section 6 until the job is complete.
Once a provider accepts, you can message them through FixlyPros to arrange access and timing. Arrange scheduling through the platform so there is a record if something is disputed later.
6. Cancellation and refunds
You can cancel a service request that has not been completed, and any payment you have made is refunded in full. There is no cancellation fee.
Refunds are returned to the original payment method. How long the money takes to appear is up to your bank or card issuer, not us.
Once a job has been marked complete it is no longer cancellable. If you are not satisfied with completed work, raise it with us through support — see section 9.
We ask that you cancel as early as you can. A provider who has set aside time and travelled for a job cancelled on the doorstep has lost real work, and repeated late cancellation may lead us to restrict an account.
7. Completing a job
A provider marks a job complete when the work is done, and must attach at least one photograph of the completed work. You are notified, and can then rate the provider.
Ratings and reviews must be honest and based on your own experience. We may remove a review that is abusive, contains personal information, or is not about the work.
8. Additional terms for service providers
This section applies to you if you provide services through FixlyPros.
- You are an independent contractor. Nothing here creates employment. You are responsible for your own taxes, insurance, licensing, and tools, and for complying with the law wherever you work.
- You must be approved before taking work, which means giving us accurate identity, business, and insurance documentation and keeping it current. Working with lapsed insurance or licensing is a breach of these terms.
- You choose which jobs to accept. There is no quota, no required availability, and no obligation to accept anything.
- Accepting a job is a commitment to do that work, at the published price, to a professional standard.
- What you earn is the published price of the service, less card processing at our standard rate and less your platform fee. Your fee rate and your earnings for each job are shown in your dashboard. Your earnings do not change based on how the customer chose to pay — we absorb that difference either way.
- Payouts go to the payout account you set up with our payment processor. You must complete their identity and tax requirements before you can be paid.
- Do not take work off-platform. Soliciting a customer you met through FixlyPros to book outside it, to avoid fees, is a breach of these terms.
9. Acceptable use
Do not:
- Give false information, impersonate anyone, or misrepresent your business, licensing, or insurance.
- Use FixlyPros for anything unlawful, or for work you are not licensed to perform.
- Harass, threaten, or discriminate against anyone on the platform.
- Post reviews that are dishonest, or arrange for reviews to be posted on your behalf.
- Create jobs that are not real, or transactions arranged to move money rather than to get work done.
- Attempt to access accounts, data, or systems that are not yours, or interfere with the platform’s operation.
- Scrape or copy content from FixlyPros for a competing service.
You can block another user at any time, which prevents them contacting you and stops you being matched with them.
10. If something goes wrong
Talk to the other party first — most problems are a misunderstanding about scope or timing, and the message thread on the job is the fastest way to resolve one.
If that does not work, contact us through support. We can see the job record, the messages, and the payment, and we will try to reach a fair outcome. We are not a court and we do not decide legal liability between a customer and a provider, but we can refund, withhold payment, or remove an account.
Damage or injury arising from the work is between you and the provider, and is what the provider’s insurance is for. Tell us as well, so we can act on our side.
11. Content you submit
You keep ownership of the photos, text, and reviews you submit. You give us permission to store and display them as needed to run the service — showing a job photo to the assigned provider, or a review on a provider’s profile. Do not upload anything you do not have the right to share, and be aware that a photo of the inside of a property is visible to the provider assigned to that job.
12. Disclaimers and liability
FixlyPros is provided as it is. We do not guarantee that a provider will accept any particular job, that the service will be uninterrupted, or that the platform will be error-free.
We screen providers before approving them, but we do not supervise their work and we are not responsible for how it is performed. To the fullest extent the law allows, Kemp Tech, LLC is not liable for indirect, incidental, or consequential loss, and our total liability arising from your use of FixlyPros is limited to the amounts you paid through the platform in the six months before the claim.
Nothing in these terms limits liability that cannot be limited by law.
13. Suspension and closing your account
You can stop using FixlyPros at any time and ask us to close your account. Obligations from jobs already booked survive.
We may suspend or close an account that breaches these terms, and may withhold payment where we reasonably believe a breach or fraud has occurred while we investigate. Where we close an account without cause, money already earned is still paid.
14. Changes to these terms
We may update these terms. If a change is material we will tell you before it takes effect. Continuing to use FixlyPros after that means you accept the change. The date at the top shows when this version was published.
15. General
- Governing law. These terms are governed by the laws of the Commonwealth of Pennsylvania, and disputes are subject to the state and federal courts located in Bucks County, Pennsylvania.
- Severability. If any part of these terms is unenforceable, the rest continues to apply.
- No assignment. You may not transfer your account or your rights under these terms.
- Entire agreement. These terms and our Privacy Policy are the whole agreement between us on this subject.
